These Terms & Conditions (“Terms”) govern the supply of goods and services by EK Wear (“we”, “our”,
“us”). By placing an order, approving a design, or engaging with our services, you agree to be bound by
these Terms.
1. GENERAL AGREEMENT
By engaging EK Wear for products or services, including but not limited to school leavers wear, uniforms,
and custom apparel, you acknowledge that you have read, understood, and agree to these Terms.
These Terms apply to all orders placed via email, phone, in person, or through our website.
2. PRODUCTS & CUSTOM MANUFACTURING
EK Wear specialises in custom-made apparel including (but not limited to):
Due to the custom nature of our products:
- School leavers jerseys
- Polos
- Hoodies and jackets
- Sashes and accessories
Due to the custom nature of our products:
- Minor variations in colour, fabric, or finish may occur
- Digital mock-ups are indicative only
- Final production will follow approved artwork and specifications
3. ORDERS & APPROVALS
Orders are only confirmed once:
- Final design has been approved in writing (email approval accepted)
- Sizing lists and quantities are confirmed
- Any required deposit or payment has been received
- Names
- Spelling
- Sizes
- Design approvals are correct prior to confirmation.
4. PRICING & PAYMENT
- All pricing is quoted in AUD unless otherwise stated
- Pricing is valid for a limited time and may change prior to order confirmation
- Deposits may be required before production begins
- Full payment must be made prior to dispatch unless otherwise agreed in writing
5. CANCELLATIONS & CHANGES
Because all goods are custom manufactured:
- Orders cannot be cancelled once production has commenced
- Changes after approval may not be accepted
- Any costs incurred prior to cancellation may be charged to the customer
6. DELIVERY & TIMEFRAMES
- Estimated production and delivery times will be provided at the time of order
- Timeframes are estimates only and may vary due to supply chain, production volume, or peak season demand
- EK Wear is not liable for delays outside of our reasonable control
7. RETURNS, REFUNDS & FAULTY GOODS
As products are custom-made:
- We do not offer refunds or exchanges for change of mind
- Incorrect sizing approved by the customer is not eligible for return or refund
- Incorrect information approved by the customer (e.g. spelling, design) is not eligible for refund
or replacement
However, we comply with the Australian Consumer Law (ACL).
You are entitled to a remedy (repair, replacement, or refund where applicable) if:
- The product is faulty
- The product is significantly not as described
- There is a major manufacturing defect
All claims must be made within a reasonable timeframe after delivery.
8. SAMPLES & DESIGN APPROVAL
Where samples are provided:
- Samples are for design confirmation only
- Final bulk production may vary slightly based on manufacturing processes
9. INTELLECTUAL PROPERTY
All designs, mock-ups, and artwork created by EK Wear remain the intellectual property of EK Wear
unless otherwise agreed in writing.
Customers grant EK Wear permission to use supplied logos or school branding for production purposes only.

10. LIABILITY
To the maximum extent permitted by law:
- EK Wear is not liable for indirect or consequential loss
- We are not responsible for delays caused by third parties or force majeure events
- Liability is limited to replacement or repair of faulty goods under Australian Consumer Law
11. FORCE MAJEURE
EK Wear is not responsible for delays or failure to perform due to events beyond our control, including
but not limited to:
- Natural disasters
- Supply chain disruptions
- Government restrictions
- Transport delays
- Factory downtime
12. WEBSITE USE
Users of ekwear.com.au agree not to:
- Copy, reproduce, or misuse content or designs
- Use the website for unlawful purposes
- Attempt to disrupt or interfere with website functionality
13. PRIVACY
Your personal information is handled in accordance with our Privacy Policy, which complies with the
Privacy Act 1988 (Cth) and Australian Privacy Principles.
14. GOVERNING LAW
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to
the jurisdiction of NSW courts.
